Terms of Use

These terms set out the conditions of use for Folyze Trade (including the website and the mobile applications, the "Service"), provided by <3 (Less Than Three, "we"). By using the Service, you are deemed to have agreed to these terms.

The Service connects to a MetaTrader 5 trading account that you hold, retrieves its trade history, aggregates and visualises it, and delivers notifications according to your settings.

The Service only reads your account information. It never places, modifies or closes an order, or carries out any other trading action.

The figures, statistics, charts and other information the Service displays are reference information aggregated from your own past trading records. They are not investment advice, an invitation to invest, or a recommendation of any particular financial product.

We are not a registered financial instruments business operator, nor are we registered for investment advisory or agency work. Investment decisions are yours alone to make.

Past performance does not guarantee future results. Margin foreign exchange trading can produce losses exceeding your principal.

The information the Service displays is based on information obtained from your trading account and from external data sources. We do not warrant that it is accurate, complete or current.

Values supplied by your broker, network conditions, failures in external services and similar causes may make what the Service shows differ from the actual state of your account. For trading and tax decisions, always check the official records issued by your broker.

• You are responsible for managing your account credentials and API keys.
• We are not liable for damage arising from a third party's use of your credentials or API keys.
• You can delete your account at any time from the settings screen in the app. Deletion erases all of your data in the Service, and it cannot be restored.

When using the Service, you must not:

• break the law or act against public order and morals;
• connect another person's trading account to the Service without authorisation;
• interfere with the operation of the Service, or attempt to access it improperly;
• place an excessive load on the Service through automated access;
• use or disclose a third party's information obtained through the Service without that third party's consent; or
• copy, modify or reverse engineer the Service, or use it in any other way we have not permitted.

You may use the sharing feature to let third parties view your performance. Anyone who knows the share URL can view it without signing in, so how widely you distribute it is your responsibility to manage.

We are not liable for any disadvantage arising from sharing.

We may change what the Service does, or suspend it, without notice to you. If we terminate the Service, we will announce it in the Service a reasonable period in advance.

If the Service is unavailable because of maintenance, a failure, an outage at an external service or any similar cause, our liability for that period is governed by Article 9 in the same way.

Except where we act intentionally or with gross negligence, our liability for damage you suffer through your use of the Service is limited to the total fees you paid for the Service in the 12 months before the damage occurred. This paragraph applies only to negligence that does not amount to gross negligence.

Even where we are liable, our liability is limited to ordinary, direct and actual damage, and does not extend to lost profits, lost trading opportunities or other indirect damage.

We may change these Terms when we consider it necessary. When we do, we will post the new text and its effective date on this page, and the change takes effect 7 days after that posting. For significant changes that disadvantage users, we also announce them in the Service.

These terms are governed by Japanese law. Any dispute relating to the Service is subject to the exclusive jurisdiction, in the first instance, of the court with jurisdiction over our address.
